These legal documents are translations for convenience. The Spanish version governs.

1. Definitions

For the purposes of these Terms:

  • Producit refers to [REVISAR ABOGADO: razón social legal completa, p.ej. "Producit SpA" o equivalente], a Chilean company domiciled at [DECISIÓN PENDIENTE: dirección comercial], hereinafter the “Provider”.
  • Customer refers to the natural or legal person who contracts the Service.
  • Service refers to the Producit SaaS platform accessible via web and mobile.
  • Users refers to the persons authorized by the Customer to access the Service.
  • Customer Data refers to all information uploaded by the Customer or its Users to the Service.
  • Guests refers to external counterparties (promoters, vendors, end clients) to whom the Customer grants scoped access according to its workspace.

2. Service and scope

Producit is operational and financial control software for live event production companies. The Service includes the features described on the public pricing page at the time of contracting, according to the chosen plan.

The Customer acknowledges that the Service is provided “as-is”, with the features available at the time of use. Producit may modify, add or discontinue specific features with prior notice to the Customer via email or in-app, with a minimum of [REVISAR ABOGADO: 30 o 60 días según práctica chilena] for material changes.

3. Account, users and roles

The Customer designates at least one Account Administrator responsible for User management. The Customer may add internal Users at no additional cost within the operational limits of its plan.

The Customer is responsible for:

  • Maintaining the confidentiality of credentials.
  • Activating two-factor authentication (2FA) on accounts with administrative permissions.
  • Immediately notifying any unauthorized access to security@producit.cl.

4. Plans and billing

The current plans and their prices are published at /precios or equivalent. Billing is performed:

  • In Chilean Pesos (CLP) or Unidades de Fomento (UF) for Customers domiciled in Chile.
  • In U.S. Dollars (USD) for Customers domiciled outside Chile.

The default frequency is monthly. The Customer may opt for annual billing with the discount published at the time of contracting.

5. Cancellation and refunds

The Customer may cancel its subscription at any time from its account settings or by requesting it at soporte@producit.cl.

  • Cancellation during the billed period: the Customer retains access until the end of the paid period. There is no pro-rata refund of the current period.
  • Cancellation during trial: no charge, no obligation.
  • Data export: the Customer may download all of its data in CSV format at any time, during and up to 90 days after cancellation.

6. Customer data ownership

Customer Data is and remains the property of the Customer. Producit acts as a data processor under the terms of Law 19.628.

Producit:

  • Does not access Customer Data except for authorized support, technical maintenance or legal compliance.
  • Does not use Customer Data to train AI models or for its own commercial purposes.
  • Does not sell or share Customer Data with third parties except for necessary subprocessors listed at /legal/privacidad.

Upon cancellation, the Customer may:

  1. Download all of its data in CSV format.
  2. Request complete deletion by emailing privacy@producit.cl. Effective deletion within a maximum of 30 days, except for retention required by law.

7. Availability and SLA

  • Tier 1 (Operación): best effort. Target availability 99.0%. No contractual SLA.
  • Tier 2 (Productora): target availability 99.5%. Support 24 business hours.
  • Tier 3 (Estudio): contractual availability 99.9%. Support 4 business hours. Credits for non-compliance.

8. Confidentiality

Each party undertakes to keep confidential the non-public information exchanged under this contract. This obligation survives termination of the contract for [REVISAR ABOGADO: típicamente 3 a 5 años].

9. Indemnification

10. Limitation of liability

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Chile.

Any dispute will be submitted to the courts of [REVISAR ABOGADO: típicamente Santiago de Chile, Tribunales Ordinarios], with the parties waiving any other jurisdiction.

12. Changes to these terms

Producit may modify these Terms. Material changes will be notified to the Customer with at least [REVISAR ABOGADO: 30 días] notice via registered email.

If the Customer does not accept the new terms, it may cancel without penalty within the notice period.
